1. ACCEPTANCE OF TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Scono ("we", "us", or "our") governing your access to and use of the scono.co website and associated online games (collectively, the "Service"). By accessing or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you are not authorised to use or access the Service.

We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Service. Your continued use of the Service after any such change constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. ELIGIBILITY

The Service is intended for users of all ages, including minors. By using the Service, you represent that you are either: (a) at least 13 years of age and have the legal capacity to enter into these Terms; or (b) using the Service under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf. Users under the age of 13 must obtain verifiable parental consent before using the Service.

We reserve the right to refuse service to any person at any time and for any lawful reason.

3. DESCRIPTION OF SERVICE

Scono is a browser-based multiplayer gaming platform that allows users to create and join virtual game rooms to play party games online in real time. The Service requires no account registration and is provided free of charge to end users. Access to the Service requires an internet connection and a compatible web browser.

We reserve the right to modify, suspend, or discontinue any aspect of the Service, including specific games, features, or functionality, at any time without notice or liability.

4. ACCEPTABLE USE POLICY

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. By using the Service, you agree that you will NOT:

Attempt to gain unauthorised access to any part of the Service, its servers, networks, or any systems connected to the Service
Use the Service to transmit, post, distribute, or share any content that is illegal, defamatory, obscene, pornographic, adult in nature, hateful, discriminatory, harassing, threatening, or otherwise objectionable
Post or transmit content that violates the intellectual property rights, privacy rights, or other rights of any third party
Use the Service to transmit unsolicited commercial communications (spam), chain letters, or mass messaging
Flood chat systems, create excessive game rooms, or take any action that places an unreasonable burden on the Service's infrastructure
Use automated scripts, bots, scrapers, or other automated tools to interact with the Service without our prior written consent
Reverse-engineer, decompile, or disassemble any component of the Service
Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
Use the Service to engage in any form of unlawful activity, including but not limited to fraud, money laundering, or the facilitation of cybercrime
Attempt to introduce malware, viruses, trojan horses, worms, or other harmful code into the Service

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your access to the Service, and we reserve the right to report such violations to applicable law enforcement authorities.

5. USER-GENERATED CONTENT

The Service allows users to submit user-generated content ("UGC"), including but not limited to player names, room names, chat messages, drawn images, and in-game answers. You retain ownership of any UGC you submit; however, by submitting UGC, you grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, adapt, and display such content solely for the purposes of operating and improving the Service.

We explicitly prohibit UGC that is:

Illegal: Content that violates any applicable local, national, or international law or regulation
Adult or sexually explicit: Pornographic, sexually suggestive, or otherwise inappropriate content, particularly given the Service is accessible to minors
Hateful or discriminatory: Content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, national origin, or other protected characteristics
Harassing or threatening: Content designed to intimidate, bully, or cause distress to other users
Infringing: Content that infringes the copyright, trademark, or other intellectual property rights of any third party

We actively monitor UGC and reserve the right to remove any content that violates these Terms at our sole discretion, without notice and without liability to you. We further reserve the right to restrict, suspend, or terminate the access of any user who submits prohibited UGC. While we strive to enforce these standards consistently, we do not warrant that all prohibited content will be identified and removed immediately.

6. INTELLECTUAL PROPERTY

All content and materials on the Service that we have created, including but not limited to the website design, graphics, logos, game mechanics, code, and text, are the exclusive property of Scono or our licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in or to such materials, except the limited right to use the Service as set forth herein.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any materials from the Service without our express prior written consent.

7. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCONO AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED TEN EUROS (€10.00).

9. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

We respect the intellectual property rights of third parties and expect users of the Service to do the same. In accordance with the Digital Millennium Copyright Act and similar legislation in other jurisdictions, we will respond to properly submitted notices of alleged copyright infringement.

If you believe that content available on or through the Service infringes your copyright, please submit a notice containing the following information to us via our contact page:

Identification of the copyrighted work claimed to have been infringed
Identification of the material that is claimed to be infringing and information sufficient to permit us to locate it on the Service
Your contact information, including your full legal name, postal address, telephone number, and email address
A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or applicable law
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner

We reserve the right to remove content alleged to be infringing without prior notice and without liability to you.

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We encourage you to review the terms and privacy policies of any third-party services you visit. Our inclusion of a link does not imply endorsement of the linked site or service.

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising under or in connection with these Terms or the Service that cannot be resolved informally shall be subject to binding arbitration or, where arbitration is not permissible, the exclusive jurisdiction of the courts of the relevant jurisdiction. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

We reserve the right to update or modify these Terms at any time at our sole discretion. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Service following the posting of changes constitutes your binding acceptance of such changes.
